Terms of Service

These Terms of Service ("Terms") govern your use of the NegotiAuto website and our car negotiation service. By purchasing our service, you agree to these Terms. NegotiAuto is operated by Appitect Mobile Developments Inc., operating as NegotiAuto ("NegotiAuto", "we", "us").

1. Our service

• NegotiAuto is a negotiation service for the purchase of new vehicles. We do not currently handle used vehicles.
• Based on the vehicle preferences you give us, we contact dealers, request and compare quotes, and negotiate on your behalf. We present the offers we obtain to you.
• NegotiAuto is not a car dealer and does not sell, lease, or finance vehicles. We do not take possession of any vehicle or handle the purchase price.
• You make the final purchase decision. If you choose to buy, you contract directly with the dealer, and the dealer is solely responsible for the vehicle, its delivery, warranty, pricing documents, and the terms of your purchase or financing agreement.
• We can't guarantee that a particular vehicle, trim, colour, or price will be available, or that a dealer will honour a quote until a binding agreement is signed between you and the dealer.

2. Fees

• Our regular fee is $499 CAD, a one-time flat fee per vehicle, plus applicable HST.
• Founding client offer: for a limited time, our first 10 clients pay $249 CAD, plus applicable HST. The offer ends when 10 spots are filled or when we choose to end it, whichever comes first.
• Prices shown on our website are before tax. HST (13% in Ontario) or the GST/HST that applies in your province is added at checkout.
• Fees are paid upfront through Stripe and are charged in Canadian dollars.
• Each engagement covers negotiation for one vehicle. Once we've started work, the vehicle can't be switched for a different one; a different vehicle requires a new engagement.

3. Money-back guarantee

If we can't save you more than our fee compared to the best price you've already found, we'll refund 100% of your payment. Here's exactly how that works.

How savings are measured. Savings are measured against the selling price of the exact vehicle (same make, model, trim, and options), before taxes, including any dealer markup or market adjustment and any mandatory dealer fees. Savings are not measured against MSRP.

The benchmark price.

• If you have one, the benchmark is a written or emailed quote from a Canadian dealer for the same vehicle and trim, which you provide to us before we begin negotiating.
• If you don't have a quote, the benchmark is the first written quote we obtain for that vehicle.
• Quotes you provide after we've started negotiating are not used as the benchmark.

Requesting a refund. Send your request in writing through our contact form within 14 days after we present our final offers. Approved refunds are issued to your original payment method within 10 business days.

When the guarantee doesn't apply.

• You change the vehicle or its specification (make, model, trim, options, or colour) after we've started work.
• You don't respond to us for 14 days or more while we're working on your deal.
• You buy the vehicle using an offer we obtained that beat the benchmark by more than our fee. In that case we've delivered on the guarantee, so no refund applies.

4. Cancellations

You can cancel for a full refund at any time before we contact any dealer on your behalf. Once we've contacted a dealer, the fee is no longer refundable on cancellation, but the money-back guarantee above still applies.

5. No dealer commissions

We are paid only by you. We do not accept commissions, referral fees, kickbacks, or any other compensation from dealers or manufacturers.

6. Your responsibilities

• Give us accurate and complete information about the vehicle you want, your trade-in, and any quotes you already have.
• Respond to us in a reasonable time so offers don't expire.
• Review every dealer agreement carefully before signing. Financing and trade-in guidance we give is general information, not financial advice.

7. Limitation of liability

To the extent permitted by law, NegotiAuto is not liable for the acts or omissions of any dealer, manufacturer, lender, or other third party, including the condition, delivery, warranty, or pricing of any vehicle. Our total liability to you for any claim related to our service is limited to the fee you paid us. We are not liable for indirect, incidental, or consequential losses. Nothing in these Terms limits any rights you have under applicable consumer protection laws.

8. Privacy

Our Privacy Policy explains how we collect and use your personal information.

9. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there.

10. Changes to these Terms

We may update these Terms from time to time. The version in effect when you pay applies to your purchase.
